On-line sales

The purpose of these terms and conditions is to define the terms and conditions of sale between the H.P.T.E. reservation centre and the user, from the placing of the order through to payment, and to regulate all the stages necessary for the placing of the order and ensure that the order is followed up between the contracting parties.

The order

The user may place an order online :

  • either from products sold online by H.P.T.E. (CityBreak online sales module)
  • or directly from the reservation code references in the commercial catalogues published by H.P.T.E..

The order can only be registered on the site if the user has clearly identified himself by entering his customer code (login and password chosen by the Internet user) which are strictly personal to him.

Any order implies acceptance of the prices and description of the products available for sale.

H.P.T.E. undertakes to honour orders received on the website only within the limits of available holiday stocks. If the holiday is not available, H.P.T.E. undertakes to inform the user as soon as possible, to provide him/her with equivalent offers or, failing that, to refund all sums paid.

Sending proposals and contracts

For bookings made via the H.P.T.E. website, the user will receive the contract proposal from H.P.T.E. at the address left on the website within 3 working days. H.P.T.E. undertakes to send the contracts for the holidays ordered as soon as possible.

To track your current order, you can consult the status of your order online by returning to the generic search screen “ALL OUR OFFERS” and entering your login and password, or contact Customer Service under the heading “Our advisers are here to help”.

Payment options

Users can choose to pay for their purchases :

– by cheque on receipt of the contract proposal, writing their customer number on the back of the cheque and making it payable to “HPTE La Boutique des Hautes-Pyrénées” and sending the payment to the following department:

– online when ordering by credit card (Carte Bleue, e-cartebleue, Visa, Eurocard, Mastercard)

H.P.T.E. makes every effort to ensure the confidentiality and security of data transmitted over the web. To this end, the website uses a secure payment module via Athos and Crédit Agricole.

The user will be required to pay a lump sum corresponding to the cost of processing the booking of their stay (administration costs), unless they have taken advantage of a special offer exempting them from this charge.

Prices

Prices are given in euros, inclusive of all taxes. They take account of the VAT applicable on the day of the order.
Any change in the applicable rate may be reflected in product prices. Prices are subject to change at any time after this date.

Signature and proof

Any user of the site who does not have a customer number must follow a registration procedure to obtain a customer number.
This number is personal.

Any loss or omission must be reported to H.P.T.E. as soon as possible by contacting H.P.T.E. by e-mail at laboutique@ha-py.fr or by telephone on 05.62.56.70.00.

In all cases, the on-line provision of the bank card number and the final validation of the order will be deemed proof of the completeness of the said order in accordance with the provisions of the law of 13 March 2000 and will be deemed payment of the sums incurred by the entry of the items appearing on the reservation form.
This validation shall constitute signature and express acceptance of all operations carried out on the site.

Responsibility

H.P.T.E. has only a best endeavours obligation for all stages of access to the site, the order process, the dispatch of contracts or the services offered. It may not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with case law.
The holidays we sell are described and presented on the site with the greatest accuracy. If, despite all our precautions, errors should occur on this site, we shall not be held liable under any circumstances.

Duration

Should any of the clauses of this contract become null and void as a result of a change in legislation, regulations or a court ruling, this shall in no way affect the validity of or compliance with the general terms and conditions of sale. These terms and conditions apply throughout the period that the services offered by H.P.T.E. are online.

Proof

The computerised registers, kept in the computer systems of H.P.T.E. and its partners under reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.

Preservation and archiving of transactions

Order forms and invoices are archived on a reliable and durable medium so as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code.

Applicable law and jurisdiction

These conditions are subject to French law.
In the event of a dispute, and in the absence of an amicable agreement between the parties, jurisdiction is given to the competent courts of TARBES.

European Regional Development Fund (ERDF)

The project has been 65% co-financed by the European Regional Development Fund (ERDF) through the INTERREG V-A Spain, France, Andorra Programme (POCTEFA 2014-2020). The aim of the POCTEFA is to strengthen the economic and social integration of the Spain-France-Andorra cross-border area. Its aid is focused on the development of cross-border economic, social and environmental activities through joint strategies that promote the sustainable development of the territory.

The project consists of developing a tourism product based on cross-border itineraries based on the discovery of a shared territory. In concrete terms, it provides for the creation of showcase itineraries and discovery loops, based on the more local offer of the territories, directly linked to the showcase itineraries and which will enable the territories to benefit as much as possible from the effects of touring tourism.

The project does more than simply map out routes; it plans from the outset to market them by producing packaged “turnkey” holidays to be offered to consumers or intermediaries who recommend trips.

Its aim is to promote a new, integrated and sustainable tourism model, based on the economic development of a shared heritage that includes an intact and exceptional environment, high-quality food production and shared cultural traditions.

It responds to the need to renew the clientele of the areas concerned and to spread visitor numbers by adopting a new positioning for the Pyrenees, away from exclusively sporting activities and open to a wider public.

It must above all benefit the local economy and its professionals, and not just the major centres of attraction.

Cross-border cooperation makes it possible to erase administrative borders and build a comprehensive, coherent product offering that is relevant to customers.
